TERMS AND CONDITIONS

CARDIGANO is a trademark registered by the company Michel José S. j. Wautier, headquartered at Rua Antero de Quental, Nº 3 - 2º Dir 2925-389 Vila Nogueira de Azeitão in Portugal with NIPC 235058750, specializing in the sale of products via the Internet.


1. OBJECT
The Terms and Conditions of this Website result from the agreement between Michel José S. j. Wautier – CARDIGANO and its clients defined below. Any individual or legal person who orders on the website www.cardigano.com, whether a private customer or not, becomes a customer under these general conditions.

1.1. Application field
These General Sales Conditions govern the sale of products displayed on the website www.cardigano.com, on the day of order validation.
They apply whether the order was placed via the Internet, e-mail, telephone, fax or post.
1.2 Customer Acceptance
The fact that the customer validates his order automatically gives rise to the express acceptance of these General Sales Conditions.
These Conditions apply to the exclusion of all other conditions, unless otherwise agreed by both parties.
Purchasing by e-mail, telephone, fax or postal mail also implies acceptance of the gifts. They can be read directly on our website. They can also be sent by email, fax or post at the customer's request.

1.3 Modification of the General Sales Conditions
CARDIGANO reserves the right to change the conditions of use or other regulations published on the website without prior notice. Therefore, you should regularly consult the conditions of use, since the continued use of the Website presupposes the unreserved acceptance of the changes made to them and subjection to the most recent version.
The version of this regulation has a precise date, the orders are thus managed by the General Conditions in use and therefore in force on the date of the order.

1.4 Product feature
CARDIGANO strives to present the essential characteristics of the products in the best way, however the measures presented may change without prior notice. A confirmation of technical data is always possible by contacting our Customer Service or sending an email.
The proposed products comply with the European legislation in force and the standards applicable in Europe.

1.5 User's Manual
CARDIGANO strives to provide, whenever possible, the user manual in the consumer's language. There are, unfortunately, situations in which the same may not be provided on paper, being only in computer format or downloading it directly from the Internet.

1.6 prices
The sales prices indicated on the website are in Euros, with taxes and fees included in the retail prices. Shipping costs are the responsibility of the customer and are charged at the end of the order.
Product prices may be subject to change at any time.
All prices indicated are correct except for data entry errors. If an order is placed on an item whose price is incorrect, we reserve the right to cancel the order and refund the amount paid to the customer.


2. VALUE ADDED TAX (VAT)
These General Conditions are presented in order to define the sales modalities between CARDIGANO and its customers defined below. Any natural or legal person who orders on the CARDIGANO website, whether a private customer or not, becomes a customer under these general conditions.

2.1 Application
VAT applies to sales concluded with EU residents. It does not apply to non-Portuguese European Union companies with an intra-community VAT number.
VAT does not apply to sales for export (Countries outside the European Union).
The invoice accompanies the goods and certifies that VAT has been paid.
The intra-community VAT number must be mentioned when placing the order and validated by CARDIGANO. The customer is informed and accepts that all orders, where the VAT number is not mentioned or is not validated by our company, will be invoiced with VAT.

2.2 Rate
23% VAT is included in all prices.


3. ORDER
3.1
Order preparation
When the customer places his order through the site, he must fill in the form presented. Before validating the order, you must reread the form to confirm the data. CARDIGANO is not responsible for errors in sending e-mails, nor for errors in sending orders due to incorrectly filled out forms.

3.2 Order confirmation
The order confirmation is sent to the customer by e-mail after duly signed, provided that the e-mail address indicated does not present any errors.

3.3 Order cancellation
Any customer can cancel their order at any time, unless it has already been shipped to the carrier. The customer may cancel his order by phone, fax or email. In the event that the customer refuses to deliver the order, he will also lose any right to a refund.

3.4 Product availability
Our product offers and prices are valid as long as they are visible on our website and while stocks last. More extensive information may be provided by telephone, fax or email.
If CARDIGANO is unable to obtain a certain raw material from the suppliers within the indicated period, the customer will be informed of the status of the order via email or telephone.


4. PAYMENT

In case of partial shipment of an order, only the value of the shipped goods will be debited. 
CARDIGANO reserves the right to refuse an order.

4.1 Payment method
The customer can pay using the following payment methods: Collection and Multibanco (for all shipping options).

4.2 Failure to pay
CARDIGANO reserves the right to refuse to make a delivery or to fulfill an order from a customer who has not paid for the entirety of the product ordered.
All payments must be made within a maximum period of 1 working day after placing the order. After this period, the order will be cancelled.

4.3 Anti-fraud Control
Any type of abusive card counterfeiting will be subject to immediate legal action.

4.4 Reservation of title
CARDIGANO retains ownership of the products until payment is made by the customer.
If you are a customer with a current account at CARDIGANO, payment must be made in accordance with previously agreed conditions. Valid for Professional Customers.


5. INVOICE

The purchase order made by the customer does not serve as an invoice. Regardless of the type of order and method of payment, the customer will only receive the invoice together with the goods at the time of delivery.
CARDIGANO keeps a digital copy of each invoice.


6. DEADLINES

6.1 Order preparation deadlines
Orders placed over the Internet are processed on a first-come, first-served basis from Monday to Sunday.
The processing period for an order varies depending on the period indicated next to each product.


7. PACKAGING

The products to be shipped are packed and conditioned so that they arrive at the place of delivery in perfect conditions, always taking into account customer satisfaction.

7.1 Confirmation
If the customer has placed his order on the website, an order confirmation email will be sent. If the email indicated by the customer is wrong, the order will be processed after confirmation of your payment.


8. DELIVERY

8.1 Place of delivery
Orders are delivered to the delivery address indicated by the customer on the order form.

8.2 Absence on the day of delivery
You will be informed of the expected delivery date of your order. You must indicate a delivery address where someone is always present between 9 am and 6 pm, such as at work. If delivery is not completed, the customer will have to pay a new delivery fee.

8.3 Delivery deadlines
Estimated delivery time is 1-3 business days for Mainland Portugal and 3-9 business days for Madeira and Azores. (Delivery times are estimated, and are only considered valid when there are no physical or structural impediments (incorrect addresses or force majeure setbacks, such as strikes, lost connections, etc.)

8.4 Receipt of the order.
We recommend that all orders delivered must be subject to verification and control, and that the customer makes any notes on the condition of the product in the shipping guide, in case of partial or total deterioration.
Without the proper notes from the customer, the order cannot be object of further contestation with CARDIGANO.
The verification of the product's status is considered to have been carried out once the shipping guide has been signed.

8.5 Order content error
Upon receipt of the order by the customer, the latter must indicate by telephone, fax or email to CARDIGANO the claim of non-conformity of the products in type, quality or quantity in comparison with the data of the order placed. The claim of non-compliance must be made within a maximum period of 24 hours from the delivery of the order.
Claims not made in accordance with the rules defined above and within the indicated deadlines will not be accepted by CARDIGANO.

8.6 Theft, failure and loss
All our orders are covered by insurance against loss. In case your order is lost, CARDIGANO will refund the entirety in a voucher or make a second shipment at no additional cost. The order is only considered lost after confirmation by the transport company.
We guarantee our best effort to solve all problems in the best possible way and with the least inconvenience and with all the quality for our customers.


9. RETURNS

9.1 Conditions
The customer has the right to return the purchase within a maximum period of 15 days from the date of delivery of the good/order.
If the consumer chooses to be refunded, this refund will be made within 30 days following receipt of the product by CARDIGANO.
If you want to make a return, you must contact us in advance via email info @ cardigano.pt, by phone number 915 417 230 and tell us if you want to exchange the item or get a refund.
In case of return and if there is an offer for a delivery fee applied to the order, the offer will be canceled and the value of the same will be deducted from the amount to be returned.

9.2 Internal error
CARDIGANO is responsible for the return and reshipment costs if there is an internal error and the product sent does not correspond to the order. If you wish to exchange for a different item, the return and reshipment costs will be the responsibility of the customer.

9.3 Defects of origin
CARDIGANO is responsible for the return and return costs if the product is defective in origin. In this situation the exchange will have to be made for the same article. If you wish to exchange for a different item, the return and reshipment costs will be the responsibility of the customer.

9.4 Transport Damage
CARDIGANO is responsible for the return and return costs if the order has been damaged during transport. In this situation the exchange will have to be made for the same article. Important note: We recommend that you pay attention to the external condition of the packaging, as it may reflect possible damage to the product.
Upon delivery and in the presence of our team, you must check the status of the product before signing the Shipping Guide and thus accepting the order.
The verification of the product's status is considered to have been carried out, once the Shipping Guide has been signed.

9.5 Images of the articles
The images on this site are for illustrative purposes only. If you are not sure which item you are looking for, please check all information with the technical department before ordering, as returns for technical reasons will be the sole responsibility of the customer.

9.6 Personalized goods
Returns, cancellations or refunds do not apply to personalized goods, which is provided for by law: "Supply of goods produced or ordered according to the consumer's specifications or manifestly personalized cannot be returned."

9.7 Decrees-law
The information regarding the consumer's right to terminate the contract (private customer) is described in detail in Decree-Law no. 143/2001 and in Decree-Law no. 82/2008.
Regarding the right to terminate the contract by Companies, Institutions, Liberal Professionals and Individual Entrepreneurs, the general law of the Portuguese civil code applies, namely the rules set out in Decree-Law 67/2003.

9.8 Dispute Resolution Platform
Pursuant to Regulation (EU) no. 524/2013 of the European Parliament and of the Council, of 21 May 2013, on the resolution of online consumer disputes (RLL Regulation), we inform you that there is a dispute resolution platform where consumers and traders can register their complaints and monitor their evolution. The European Commission thus wants to reinforce confidence in online shopping. 10. INTELLECTUAL PROPERTY

The User is not authorized, under any circumstances and by any means, to store, copy, reproduce, change, distribute, sell or in any way make the information to which he has access within the scope of this use accessible to third parties. , unless for exclusively private purposes and free of charge. The User is solely and exclusively responsible for the misuse of the information to which he has access within the scope of this website.

The User recognizes CARDIGANO's intellectual property rights over the contents / elements of the website that do not come from third parties, identified as such, including the graphic design of the page, texts, images, graphics, logos, domains and brands, not being the user authorized to reproduce, copy, alter, disclose or, in general, to practice any act that, under the terms of the applicable legislation, constitutes a violation of the rights that CARDIGANO holds. Any fraudulent use of these rights constitutes a crime of counterfeiting, severely sanctioned by the Intellectual Property Code.


11. ACCEPTANCE OF TERMS AND CONDITIONS

The User is responsible for any cost, expense, damage or loss, regardless of their nature, borne by CARDIGANO due to the user's failure to comply with these "Terms and Conditions".
